The day when EC became almighty !!!

“Even if the speaker has sent us the letter, the power to establish whether there is a casual vacancy or not is by the EC. Even we have received the letter by the Speaker, we will study and hold a special meeting to decide if we are going to accept the resignation. In the case of Perak, we rejected the resignations - Malaysian Insider (24/3/2010).

This is the price we are paying when suddenly EC became so powerful that democratic right of Malaysian is compromised when a Civil Servant can decide whether a seat becomes vacant or not. This is the dire price and consequence we are now facing when EC becomes too almighty.

When our PR Speaker, YB Sivakumar announces the resignations of the three kataks in Perak, the EC refused to accept the Speaker decision and held that they have not resigned. However in this case, the Perlis Speaker himself admitted that he has received the resignation letter from Titi Tinggi and yet, the EC refused to accept the fact !!! Is it simply because the EC knows that the BN, especially the PM is trying very hard to persuade the elected rep to retract his resignation. How long do we have to wait until EC accepts the resignation ?

What if Yip Sau Onn is adamant and his decision is final ? Will the Chairman of EC, Tan Sri Dato Seri Aziz bin Mohd Yusof take and accept full responsibility for it ?

When an ADUN resigns, he/she can not retract the decision because the resignation has taken effect and the only decision the Speaker can made is to declare the seat as being vacant. If he is allowed to retract, and serve as elected rep, illegality can be challenged in Court of Law as from the moment of his resignation he/she is no longer an elected rep.

We need to stand up and correct the wrongdoing of the EC and BN. We cannot allow them to trample and interfere with the democratic process and rightfully, this democratic right must be given back to the rakyat.

Let us kick BN out in the coming GE-13.

ADUN for Titi Tinggi resigns

It is reported in Malaysiakini that MCA's Assemblyman Yip Sun Onn has resigned with immediate effect citing irreconcilable different with certain party leaders and this was confirmed by the Speaker. A by-election would have to be held within 60 days.

Yip Sun Onn would be the first ADUN to resign paving way for a by-election in this current term. This is an honourable act to do since he was elected on MCA ticket rather than hopping to become an independent.

We are ready for the by-election and I believe we have a good chance of winning the seat. We in Pakatan Rakyat shall work together to ensure victory to PR !!

Hidup Pakatan Rakyat !! Hidup Rakyat !!

Service Center Pasir Pinji

*LEGAL EAGLE MORE THAN HAPPY TO SERVE *
Date :12 January 2009

*TWO*-term Pasir Pinji assemblyman Thomas Su Keong Siong is well known for his strong commitment to the needs of his constituents.

He is a leader who is more concerned with keeping his house in order rather than politicking and due to this has earned great respect from his constituents regardless of race.

A lawyer by profession, the 42-year-old DAP politician is also very popular with his voters due to his vast legal knowledge. He is the main source of reference for those seeking legal advice which he usually provides for free during meet-the people sessions at his service centre along Jalan Sultan.

As for Su, he is glad that his legal knowledge has helped him perform his duties as well as developing personal contacts with those who had voted for him.

Speaking to Perak News Online recently, Su who is also state Higher Education, Science, Technology and Communications Committee chairman said an immediate solution was needed to solve the flash flood problem affecting 50 homes in Kampung Baru Pasir Pinji.

He said the affected residents were losing their patience as they have been putting up with the problem for quite sometime and incurred a lot of losses in terms of damage to their property.

He urged the state Drainage and Irrigation Department to speed up deepening Sungai Pinji to stop water from overflowing to the nearby housing estates whenever it rains.

Besides being heavily silted, he said Sungai Pinji was also facing serious clogging problems due to the attitude of the residents who tend to throw rubbish into the river.

Being one of the urban constituencies, issues such as irregular collection of rubbish and clogged drains are among the mounting complaints Su has to deal with. He said the problem would not be tackled unless the Ipoh City Council bucked up and provide a more efficient service to the people.

Touching on other matters, Su said the decision by the state government to allow the conversion of land titles from leasehold to permanent status was well received by the Pasir Pinji New Village residents.

So far, more than 1,000 villagers in his constituency have applied for the conversion, said Su who won with a thumping 6,993 vote-majority in the March 8 general election.

He said voters in his area had requested for the Pasir Pinji market to be upgraded, adding they were unhappy with the RM200,000 upgrading work carried out by Barisan Nasional. The residents, he said, claimed the contractor had carried out a sloppy job.

Su said he had tackled some of the minor issues affecting the market such as frequent power failures by replacing the old wiring system using the allocation he received from the state government.

He also lamented at the absence of a proper public transport system in Pasir Pinji, adding that he hoped the problem would be solved with the state government's proposal to introduce a more efficient bus service.

Meanwhile, several voters when met expressed confidence in the ability of the Pakatan Rakyat state government to administer and develop the state.

Former teacher Hoh Chak Shon, 68, from Taman Melor said he believed Su would continue being a good wakil rakyat based on his excellent track record. He said Su's humble and friendly character has made it easy for people to work with him.

Koh Toh Long, 62, from Pasir Pinji New Village said the Pakatan Rakyat state government has done a lot of good to the people by issuing permanent land titles to them. He said the new land policy has ended his 40-year long wait to get a permanent land title.

BN must kick Hamidah out of the party for her racist remarks !

It is a shame that after 51 years of independence, we still see racial remarks being made by Assemblyman in the just concluded Perak State Assembly sitting. I must say that i was bitterly ashamed that such an offensive remarks were made by a BN State Assemblyman and immediately protested against such racist remarks !

It is rather hypocritical that the BN Government should spend billions of Ringgit to instill racial harmony and understanding amongst the the teenagers through the National Service Program (PKLN) but its leaders continues to harp on racial issues. It makes me wonder whether the BN Government is serious in promoting racial harmony and unity when we can still have BN Assemblyman uttering such racist remarks in the August house, whether intentional or not.

The BN party must take immediate action against the said Assemblyman to restore credibility and clearly, the BN party has not learn from the March 08 election that racial sentiments no longer have any place in Malaysian politics. They must show that BN has really changed from the old ways of racial politics if they are to stay relevance in Malaysian poltics.

Even though Hamidah Osman has apologised for her racial slur, the rakyat demand to see that BN take a stern action against her to ensure that such racist remarks are not tolerated at all. In my mind, a mere apologies is insufficient to repair the damage and hurt done to the Indian community. Therefore, BN should immediately take appropriate step to kick her out of the party or at least suspend her from BN. Remember that Devamany was given a stern warning for trying to raise the problems faced by the Indian Community and also Sothinathan's suspension over the Ukraine medical students issue ? I call upon the other component party like MIC MCA Gerakan and PPP to take up the challenge and have Hamidah kicked out or suspended from the BN party. Please prove that you are equal partner and worth your salt in the BN component party !

I am also saddened by the Opposition Leader for trying to defend Hamidah by saying that such fable exists in the Dewan Pustaka's Dictionary. Please correct me if i am wrong but i dare say that no such fable exist in the Dewan Pustaka' Dictionary. Even if it does, Hamidah should know that such a racist remarks should not be uttered in the August house. It is utterly irresponsible and arrogant.

Now over to you - MIC MCA Gerakan and PPP ! The ball is in your feet.

PERAK STATE ASSEMBLY SITTING

The recently concluded Perak State assembly sitting saw us answering Q & A session for the first time. I append herebelow one of the question that was answered by me during the Q & A session :

YB. ENCIK CHAN MING KAI (SIMPANG PULAI)

Isu Menara Telekomunikasi

Maka, minta Y.A.B. Menteri Besar menjawab :

Jawapan : YB Encik Su Keong Siong :

Illegal Telecomunication Structures/Towers

Today i attended to a complain regarding illegal telecommunication structure erected at No. 21, Jalan New Pasir Putih, Ipoh and i must say that i was flabbergasted to be informed by the officer from the Majlis Bandaraya Ipoh that the company who erected the telecommunication structure on the said premise have yet to obtain the approval from the local authority to do so although the company had submitted an application form o the authority. Further, i was also informed by the officer that the said company will be slapped by a higher application fee ie. RM 3,500.00 for failure to conform with the existing regulations. To me, this is a mockery where telcos companies are allowed to flout the law with a measly fine of RM 3,500.00.

I have been informed that there were many such illegal structures in Ipoh alone and a lot of these towers/structures are erected without prior approval. The telcos companies deemed that such approval are practically 'guaranteed' so long as the Guidelines set by the Federal Ministry are complied with. Certainly, something is wrong somewhere ! How can an approval be taken for granted especially in this case where the residents have protested from day one. There are three tuition centers at the buildings where the illegal telco structures are situated and also there is a primary and a secondary school nearby.

The State Authority need to come up with a proper guidelines to regulate the erection of such towers in the State of Perak. I will call for a meeting of all Local Authorities and other Agencies concerned and also the Malaysian Communication & Multimedia Commission to draw up a proper Guidelines for the State of Perak to ensure full compliance and also to avoid such illegal structures from being built without any prior approval nor regard to the Authorities.

Certainly, we cannot deny that the problems of telcos towers/structures does exists and requires the State Authorities intervention. The State need to balance the commercial needs and residents rights in such a matter. It is my wish that a win-win situation can be achieved and a clear guidelines set for the State of Perak wherein everyone will know the boundaries and limits in the erection of such structures or towers in future.

Perak to send rep to Si Chuan

IPOH: There is nothing worse than not knowing the fate of your loved ones.
Leong Sai Wai, a 32-year-old jockey, has been desperately trying to contact his grandmother and aunt since Monday's earthquake shook Sichuan province in China.

He can only hope that Louie Wai Lam, 90, and Tan Saw Im, who is in her 50s, are safe.

"There is no news," he said at a press conference organised by state Higher Education, Science, Technology and Communications Committee chairman Su Keong Siong yesterday.

Leong said the two women were in good health and would frequently go on holidays.
They have visited China several times. On their latest trip, they joined the tour organised by Ipoh Golden Dragon Tours Sdn Bhd. They were accompanied by another friend, he said.

Louie and Tan are among 26 Malaysian tourists who are unaccounted for following the earthquake.

Su said the group of mostly women aged between 60 and 90 left for the nine-day tour on May 8. They were supposed to be back in Kuala Lumpur today, he added.

Earlier, it was reported that the tour agency had contacted the Malaysian consulate in Kunming to help locate the group.

The group's last known location was at Maoxian, about 30km from the quake's epicentre.

Expressing the concern of the state government, Su announced that 41-year-old businessman Lee Choon Kiet would be going to Sichuan as the state government's representative to gather information on the tourists.

He said he was informed by Consul-General Ayauf Bachi that airlifts would begin this morning to help those in Maoxian.

The area's basic infrastructure has been destroyed, communications are down and roads have been rendered inaccessible by the earthquake.

Su said family members could contact the state government or him at 012-5280600.

Lee, who is fluent in Mandarin and a frequent visitor to China, said he would try to reach Chengdu or Kunming to look for news of the group.

Lee volunteered to be the state government representative yesterday after finding out that a family member of a close friend was also part of the tour group. NST Online

Perak's new govt seeks increased investment amid new political landscape

Related Video

PERAK : Malaysia's Perak state is calling on the federal government to respect the people's decision, as the state authority adopts policies that are non-discriminatory.

The new administration has vowed to rid the state of corruption and cronyism as it pursues increased investment amid a new political landscape.

Known as "the Silver State", Perak is famous for its great food, tin mines and limestone mountains and caves.

And the coalition state government is keen to capitalise on these areas to stimulate job creation so as to prevent the brain drain.

The Royal Belum State Park - located near the Malaysia-Thai border - is home to several globally-threatened wildlife species, including the Malayan tiger, the Asiatic elephant, the Malayan tapir, the white-handed gibbon, and the Sumatran rhinoceros.

The centuries-old rainforest park has immense eco-tourism potential just waiting to be tapped.

Thomas Su Keong Siong, DAP State Assemblyman, Perak State Executive Councillor, said, "Our Royal Belum is very rare forest, but are we really promoting it in terms of eco-tourism. I think it is very important is that we should preserve the Royal Belum, and I think one of the (ways in which) we can promote (it) is to let the world know about this beautiful place, and that a lot of scientific research can be carried out here.

"A lot of it, I believe, is unexplored. So the potential to promote it and package it in a nice way (is there), (and) then perhaps we can make it something unique to Perak. That's what people look for when they come to holidays."

In fact, plans are underway for the five Malaysian states not governed by Barisan Nasional (BN) - Selangor, Penang, Kelantan, Kedah and Perak - to set up a coordinating body to boost tourism.

Mohammad Nizar Jamaluddin, Perak Chief Minister and Perak PAS Deputy Commissioner, said, "We are here to make sure the state will continue with all the development programmes that have already been drafted earlier on by the previous government. We will enhance them, (and) we will obviously increase the level and the speed of investment, both local and international as well.

"We will try to make sure that whatever decisions that have been delaying all the processes to enrich the state will certainly be reviewed...so that any elements of bureaucracy (and) red tape will certainly be reduced. We (will) try to make sure that the country is back on its track though for the last four years it has been in deficit. So we believe that with the principles of justice, principles of caring, welfare (and) integrity, we will be able to enhance all those ideas that we have".

As for the BN, they now have to get accustomed to playing the role of the opposition.

Mohamad Tajol Ghazali, Former Chief Minister of Perak and Perak State UMNO Chief, said, "Well, we lost through a democratic process. We hope to win (it) back in the next election by a democratic process, and we still have about four years to go, so (we) have to strategise. And the main thing is all the component parties of Barisan Nasional must be on their toes and we must stay united because no single party can form the government in Perak.

"So all the component parties of Barisan Nasional must be together, they must be united and we must be sensitive to each other's problems and needs. And I think if we can stay united and we are sensitive to each others problems and needs, God willing we should come back in the next election. We would like to play a positive role in the opposition. Even though we are in the opposition, our main aim is to develop the state and to develop the people in the state.

"If ever we achieve our target of becoming a developed state by 2020, we want the state and its people to achieve that developed status. So we will play our role positively to make sure the state is developed. But at the same time, we will make sure the government of the state will be on their toes."

The governing state coalition comprises the Islamist party PAS, Parti Keadilan Rakyat and the Democratic Action Party.

But will this loose alliance be able to hold together against the rising expectations of the electorate?

The Perak Chief Minister said, "There are some elements of worries here and there. But certainly all the EXCO members, I mean the cabinet members, we have already agreed principally and professionally it should be based on certain guided universal values...We worked on the basis that (it has) nothing to do with religious sentiment, nothing to do with racist discrimination...It will certainly be based on values that are universally accepted. So if somebody (is worried) that the coalition government would not last, then give us a fair time for us to prove ourselves. But certainly based on those accepted principles, we believe that under some guided democratic principles, I think we can go on.

"The main signal is that number one, the federal government must respect the decision made by the state, by the rakyat, or the people themselves. Number two is that we are saying that we are going into a new political landscape that is not based on racial discrimination, that is not based on sentiments, or cronyism. Number three, the signal is very strong, asking people to respect that all decisions must be made on a fair basis. There must be some principles of justice. And the fourth signal is that we are going global. Being global means we have to accept universal attitudes, the way how people look at social changes, political changes as well."

Shan Theivanthiran, Lawyer and Chairman, Perak State Bar, said, "The transition from the former state government to this government has been a fairly smooth transition. However, we are awaiting to see what this state government can do. It's no longer the same old business as usual like what it was before...It's now a totally new state government. There will be teething problems. A lot of people are envisaging teething problems. And a lot of people are envisaging problems from within, between the civil servants and this particular government, because they are not used to the way things are being done.

"They are going to have a lot of high expectations of the new state government, but I feel those expectations may not be justified. Because...they are doing their best to try and curb the problems which have been faced by the previous government.
